Safety expert sees cost to testimony

GALVESTON — Industrial safety expert Mike Sawyer said his testimony against BP last week in the latest civil trial related to the 2005 Texas City refinery explosion may have cost him business after a company official shared details of what he said to another of his clients.

Now that person — Kathleen Lucas, the second-ranking official at BP's Texas City refinery — could face legal action from plaintiffs' attorneys.

Testifying last Wednesday on behalf of 14 plaintiffs suing BP for emotional and physical injuries that they claim, Sawyer was asked about the blowdown stack at the refinery that is blamed for providing the fuel in the blast that killed 15 people and hurt scores more.

High Court Strikes Down Animal Cruelty Law on First Amendment Grounds

In a strong endorsement of classic First Amendment principles, the U.S. Supreme Court on Tuesday struck down a federal law that made it a crime to create, sell or possess certain depictions of animal cruelty.

Calling the law a "criminal prohibition of alarming breadth," Chief Justice John Roberts Jr. said there was no basis for carving out such an ill-defined exception to the First Amendment. Roberts wrote for an 8-1 majority in the case, U.S. v. Stevens (pdf).

The 10-year-old statute was aimed at the growing market, especially on the Internet, of so-called "crush videos," showing the killing of helpless animals in ways that appeal to the prurient interests of purchasers. But the law defined its target broadly, outlawing depictions of intentional killing or maiming of animals if the conduct violated laws of jurisdictions where they were sold, created or possessed. It exempted depictions with serious religious, scientific, educational, journalistic, historical or artistic value.

Goldman Sachs Co-GC Surprised, 'Disappointed' by SEC's Suit

Gregory Palm, co-general counsel of Goldman Sachs Group, Inc. strongly defended his company Tuesday and told investors that the government's suit against the Wall Street giant took him by surprise.

Palm said his legal department spent the past 18 months talking and providing records to the Securities and Exchange Commission. But the agency didn't notify the company that it was filing suit last Friday. Palm said Goldman was "disappointed" by the charge.

Speaking in a conference call on the first quarter earnings report, Palm defended Goldman's integrity and business principles. The record shows the charge was unfounded, he said, and "we dispute the respective view of the facts in this case and the applicable law."

The SEC charged Goldman, Sachs & Co. and one of its vice presidents with defrauding investors. Goldman Sachs Group is the parent company of the broker-dealer.

The complaint alleges that the company misstated and omitted key facts about a financial product tied to subprime mortgages, as the U.S. housing bubble was beginning to burst in 2007.

Fired Metro counsel files suit against agency

The Metropolitan Transit Authority fired its chief counsel, Pauline Higgins, just hours after Higgins refused to allow agency employees to destroy 16 or 17 boxes of documents, according to a lawsuit Higgins filed Monday against Metro and its chief executive.

This allegation and others in the lawsuit provide the most detailed account to date of Metro's alleged effort to prevent disclosure of potentially damaging information, including documents sought in an open-records request by lawyer and former City Controller Lloyd Kelley.

Two Chevron Lawyers Indicted in Ecuador

Chevron's Ecuadorean quagmire got deeper and dirtier Friday, with the announcement that two longtime lawyers for the company have been indicted by the Ecuadorean government.

In-house lawyer Ricardo Reis Veiga and outside counsel Rodrigo Perez Pallares are accused of being part of a conspiracy to fraudulently certify that Chevron predecessor Texaco had completed the cleanup of more than 100 mines in the Ecuadorean rainforest in the 1990s. The government released Chevron from liability on the basis of those certifications.

When the Exxon Valdez ran aground in 1989, Andrew Wills was a successful herring fisherman in Alaska and the owner of three canneries.

The 11 million gallons of crude oil from the tanker destroyed the herring population and Mr. Wills’s fishing career, so he borrowed money to open a bookshop, a cafe and the Mermaid Bed and Breakfast in downtown Homer, Alaska.

Mr. Wills had expected to use his $85,000 share of the $2.5 billion punitive damage settlement against Exxon to pay off some of his debts. The United States Supreme Court decision on Wednesday cutting the damages to around $500 million means Mr. Wills will receive only $15,000, he said.

“After everything we’ve been through, that’s barely enough to cover payroll for a month,” he said. “This is a knife in the gut.”

Hazards: Golf Carts Get Around, and Injuries Rise

As golf carts zip their way off the golf course and into places like national parks, college campuses and gated communities, the number of people hurt in them has more than doubled, researchers say.

Part of the problem is that the carts are faster than they used to be. But they are also being used in ways they were not necessarily intended for and are carrying people — like children — they should not, the study said.

Writing in the July issue of The American Journal of Preventive Medicine, the researchers said that from 1990 to 2006, the injury rate had doubled. The lead author is Daniel S. Watson of Ohio State University.

Over the period studied, the researchers counted injuries in almost 150,000 people ages 2 months to 96 years.

Researchers Fail to Reveal Full Drug Pay

A world-renowned Harvard child psychiatrist whose work has helped fuel an explosion in the use of powerful antipsychotic medicines in children earned at least $1.6 million in consulting fees from drug makers from 2000 to 2007 but for years did not report much of this income to university officials, according to information given Congressional investigators.

By failing to report income, the psychiatrist, Dr. Joseph Biederman, and a colleague in the psychiatry department at Harvard Medical School, Dr. Timothy E. Wilens, may have violated federal and university research rules designed to police potential conflicts of interest, according to Senator Charles E. Grassley, Republican of Iowa. Some of their research is financed by government grants.

Like Dr. Biederman, Dr. Wilens belatedly reported earning at least $1.6 million from 2000 to 2007, and another Harvard colleague, Dr. Thomas Spencer, reported earning at least $1 million after being pressed by Mr. Grassley’s investigators. But even these amended disclosures may understate the researchers’ outside income because some entries contradict payment information from drug makers, Mr. Grassley found.

High Court Justices Cut Stock Holdings

Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr., whose investments forced them to sit out cases before the Supreme Court, have significantly reduced their stock holdings, their latest financial disclosures show.

Roberts sold all his shares in four companies last year -- Becton Dickinson, Cisco Systems, Citigroup and Merck -- worth $117,000 to $265,000.

Citigroup and Cisco were connected to pending cases in which Roberts initially declined to participate. Then he sold his shares in time to take part in the argument session and decision.

In those instances, Roberts became the eighth participating justice, averting the possibility of a 4 to 3 ruling.

In March, Roberts's stake in Pfizer left him unable to participate in a dispute over patient lawsuits against drugmakers. The court divided 4 to 4.

Alito sold all his stock in Intel, worth $15,000 to $50,000, and reduced his holdings in three other companies, Bristol-Myers Squibb, Exxon Mobil and McDonald's.

It might have been bearable if the horror had stopped when Paul Gayter and his wife Flora Nicholas learned that their 9-year-old daughter had been molested by a hotel employee during a family vacation.

Or if it had stopped when the hotel's insurer, American International Group, decided on exceptionally tough tactics -- endless depositions, private investigators and psychological tests -- to prevent a payout to the family. Or when federal prosecutors, perhaps acting on a tip from lawyers for the insurer and hotel, started questioning the family's immigration status (they're from Britain) and launching criminal probes into their business dealings. Or when a settlement deal with the hotel fell apart and the battle headed back to court.

But it hasn't ended. Eight years after their daughter was attacked, the Gayters' fight grinds on. Lawsuits have snaked through two federal trial courts and two federal appellate courts. At least 20 lawyers have worked on the matter, including litigators from some of the top firms in the country. Lawyers for the hotel have been admonished repeatedly for overreaching discovery tactics. Yet they've been able to bat down a jury trial.

A study of court settlements in personal injury lawsuits against businesses estimated companies could save an average total of $114,000 per claim or $670,000 for severe injuries by promptly settling cases instead of fighting them in court.

The study, which was published this month in the Columbia Business Law Review, also projected $32,000 in savings from lower legal expenses, or about $211,000 for cases involving severe injuries.

June 7 (Bloomberg) -- Taser International Inc., the largest stun-gun maker, lost a $6.2 million jury verdict over the death of a California man who died after police shot him multiple times with the weapon. The defeat is the first for Taser in a product- liability claim.

A San Jose, California, jury yesterday said Taser had failed to warn police in Salinas, California, that prolonged exposure to electric shock from the device could cause a risk of cardiac arrest. The jury awarded $1 million in compensatory damages and $5.2 million in punitive damages to the estate of Robert Heston, 40, and his parents. The jury cleared the police officers of any liability.

The Los Angeles city attorney's office plans to sue Time Warner Cable Inc. today, alleging that the company caused "major havoc and distress" when it became the No. 1 pay TV provider in Southern California two years ago.

City Atty. Rocky Delgadillo said Wednesday that Time Warner violated state law by making false and misleading statements to subscribers. The 25-page lawsuit, a copy of which was reviewed by The Times, claims the company violated its franchise agreement with the city by having subscribers spend hours on hold with customer service representatives and allowing excessive repair work delays.
